California Friends and family Code Section 3042(a) reads that if a child is determined being "of sufficient age and capacity to reason to be able to form an intelligent preference as to custody, the court shall consider and allow due weight to the wishes of the child in making a great order grating or adjusting custody. " The court pays off special attention to the reason why for the child's hopes. California Family Code Section 3042(n) specifies, however, that that the trial will determine whether the child is able to be called upon as a witness in the case and may not allow the child to be called for a witness by either party whether it is determined that it would not be in the best interests of the child.
